The ZAMboost Everyday Adventure Photo Contest Rules

The following photo contest is intended only for legal residents in the 50 United States and the District of Columbia 18 years of age and older. Void where prohibited.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

The ZAMboost Everyday Adventure Photo Contest is sponsored by ZAMboost. The photo contest is governed by these official rules. By participating in the Photo contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Photo contest, as determined by Sponsor and its agents, are final in all respects. The Photo contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.
This Photo contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. Any questions, comments or complaints regarding the promotion should be directed to the Sponsor.

ELIGIBILITY: The Photo contest is open to legal residents of the fifty (50) United States and the District of Columbia (excluding overseas military installations, Puerto Rico and other U.S. Territories) who are eighteen (18) years of age or older at the time of entry and who have Internet access and a valid Facebook and e-mail account at the time of entry.

Entrants must submit all required information to be eligible to win. Entries missing required information will be disqualified. Required information will be clearly marked on the entry form. Current and former consultants, employees, officers, consultant, associates and directors of the Sponsor, and each of their respective parents, affiliates, subsidiaries, retailers, agents, advertising and promotion agencies, and suppliers, as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents, regardless of where they reside) and individuals living in the same household as those individuals, whether or not they are related, are not eligible to enter or win. Furthermore, any entrant who has ever been convicted of a felony will not be eligible. Sponsor has the right to verify the eligibility of each entrant and disqualify those who don’t meet the eligibility requirements. Photo contest is subject to all applicable federal, state, and local laws.

PHOTO CONTEST PERIOD: Submissions to the contest will be accepted as of 11 a.m. Central time, Sept 5, 2013 and will continue to be accepted until 9 a.m. September 19, 2013 (“Photo contest Period”). All entries must be received on or before this time to be eligible. During the second phase of the contest, entries will be accepted from noon, September 19, to 9 a.m. September 26. During the third phase of the contest, entries will be accepted from noon on September 26 to 9 a.m. October 3. During the fourth phase of the contest, entries will be accepted from noon on October 3 to 9 a.m. October 10.

HOW TO ENTER: Individuals can enter the photo contest through the photo contest tab on the ZAMboost Facebook Page (www.facebook.com/zamboost). Entrants must “LIKE” ZAMboost on Facebook in order to enter.

After completing and submitting the required information on the entry form, the entrant will receive one (1) entry into the drawing. Entrants may earn extra entries by following us via Instagram.com (ZAMboost4U.)and using the hashtag #ZmbOnTheGo when posting their photos. Mass entries or mechanical reproductions, or late, lost, stolen, illegible, misdirected, damaged, inaccurate, incomplete, and/or postage due entries are void. Any attempt at entry except as above stated is void. All entries become the property of the Sponsor and will not be returned.

ADDITIONAL ENTRY CONDITIONS: Sponsor has no obligation to advise an entrant of an incomplete or otherwise non-compliant entry. Sponsor is not responsible for lost, late, invalid, unintelligible, incomplete, garbled, or misdirected entries, which will be disqualified. No mailed, telephoned, faxed, or mechanically reproduced entries will be accepted. Proof of submission of an entry will not be deemed proof of receipt. Receipt of entries will not be acknowledged nor will proof of submission of an entry form be deemed proof of receipt. In the event of a dispute as to any entry, the authorized account holder of the e-mail account used to enter will be deemed to be the entrant. The “authorized account” holder is the natural person assigned the e-mail account. Potential winners may be required to show proof of being the authorized account holder.

PHOTO COPYRIGHT: The Sponsor of this contest takes photo copyright laws very seriously. All entrants must own the rights to enter the image in the Sponsor’s photo contest. The entrant agrees that by entering this contest, they 100% own the rights to the photo they are submitting. Should a photo come into contention or question, the entrant will be asked for proof of copyright rights to the photo. Photos that are not owned by the entrant are immediately disqualified.

WINNER SELECTION: All eligible entries received during the photo contest period will be entered to win. Ten finalists will be selected from the collective entries by a panel of ZAMboost employees. Finalists will be selected based on the nature of their photo, quality of image, effort put into photo submission, and overall creativity of the photo. The 10 finalists’ photos will be posted on the ZAMboost website’s blog at www.zamboost.com/blog each week for the duration of the contest. Website visitors will vote for their favorite photo. The photo with the most votes wins for that category.

Odds of winning depend on the total number of eligible entries ZAMboost receives. The winner will be notified via the e-mail provided on the entry form. Each entrant is responsible for monitoring his/her e-mail account for prize notification or other communications related to this photo contest. If a potential prize winner cannot be reached by the Sponsor within two (2) days using the contact information provided at the time of entry, or if the prize notification e-mail is returned as undeliverable, that potential prize winner shall forfeit the prize. The potential winner may be required to sign and return an Affidavit of Eligibility, Liability Release and Prize Acceptance Form and IRS W-9 form and, unless prohibited by law. If a potential winner fails to comply with these official rules, that potential winner will be disqualified and, at ZAMboost’s discretion, awarded to an alternate winner. Prize may not be awarded if an insufficient number of eligible entries are received.

PRIZES: Winner will receive a $100 gift card and 5-day supply of ZAMboost with. First runner up will receive a 5-day supply of ZAMboost.

Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES AS WELL AS ANY COSTS AND EXPENSES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE SOLELY THE RESPONSIBILITY OF THE WINNER.

ADDITIONAL LIMITATIONS: Prize is non-transferable. No substitution, transfer or cash equivalent of prizes is permitted by the winner. The Sponsor reserves the right to substitute any prize (or portion thereof) with another of equal or greater value at Sponsor’s sole discretion. Acceptance of a prize constitutes permission for the Sponsor and its designees to use the winners’ respective name, city and state of residence and likeness for advertising and promotional purposes in any and all media now or hereafter known throughout the world in perpetuity at discretion of Sponsor without additional compensation, notification or permission, unless otherwise prohibited by law. Sponsor and its respective parent, affiliates, subsidiaries, agents, representatives, officers, directors, shareholders, and employees (“Released Parties”) are not responsible for any typographical or other errors in the offer or administration of the Photo contest, including, but not limited to, errors in any printing or posting of these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Photo contest is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Photo contest, without notice, and for any reason, including, without limitation, if Sponsor determines that the Photo contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Photo contest. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of the Sponsor.
In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. The Released Parties and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PHOTO CONTESTS MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION. INDEMNIFICATION AND LIMITATION OF LIABILITY BY ENTERING THE PHOTO CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS THE RELEASED PARTIES, THE SOCIAL NETWORKING PLATFORM THAT HOUSES THE PHOTO CONTEST (must be released according to Section 3.7.2) MARKETING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE PHOTO CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATES, SUBSIDIARIES, AGENTS, REPRESENTATIVES, OFFICERS, DIRECTORS, SHAREHOLDERS, AND EMPLOYEES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, MARKETING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE PHOTO CONTEST.

In the event of a dispute as to any entry, the authorized account holder of the e-mail address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet Service Provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. By entering the Photo contest, all entrants agree to (i) be bound by the terms of these Official Rules and the decisions of the Sponsor, which is final and binding on all matters and (ii) release and hold harmless Released Parties from any liability whatsoever for any claims, costs, injuries, losses, actions or damages of any kind (including, without limitation, related to personal injury, death, damage to property, infringement of proprietary rights, rights of publicity or privacy or defamation) arising out of or in connection with participation in the Photo contest and/or the acceptance and use of any prize (including any travel or activity related thereto).

BY PARTICIPATING IN THE PHOTO CONTEST, ENTRANT AGREES THAT THE RELEASED PARTIES (I) MAKE NO WARRANTY, GUARANTY OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATING TO THE PHOTO CONTEST AND/OR THE PRIZES; AND (II) DISCLAIM ANY IMPLIED WARRANTY.

PUBLICITY: By participating in the photo contest, each entrant grants ZAmboost permission to use his/her name, photograph, likeness or comments for publicity purposes without notification or payment of additional consideration, except where prohibited by law.
